These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and Eventlink Technologies LTD ("Eventlink", "we", "us", "our"), a company registered in England and Wales with its registered office at 71-75 Shelton Street, Covent Garden, WC2H 9JQ, London, United Kingdom.

By accessing or using the Eventlink platform and services at https://eventlink.co ("Service"), you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Service.

Definitions

"Platform" means the Eventlink software-as-a-service platform accessible at https://app.eventlink.co

"Workspace" means a separate environment within your account associated with a specific domain
"Event Page" means the event registration and information pages created using our Platform
"User Content" means any content, data, or materials you upload, submit, or transmit through the Service
"Registration Data" means information collected from event attendees through registration forms

Account Registration

2.1 Account Creation: To use our Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.2 Multiple Workspaces: You may create and manage multiple workspaces within your account, with each workspace associated with a specific domain.

2.3 Account Security: You must immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account information.

2.4 Age Requirement: You must be at least 18 years old to create an account and use our Service. By registering, you represent and warrant that you meet this age requirement.

Use of Service

3.1 Service Description: Eventlink provides a platform that enables users to create event pages, capture registrations, and manage event-related data without coding requirements.

3.2 Permitted Use: You may use the Service for lawful purposes only and in accordance with these Terms. You agree to use the Service in compliance with all applicable laws and regulations.

3.3 Service Availability: While we strive to provide uninterrupted access to the Service, we do not guarantee that the Service will be available at all times. We may perform maintenance, updates, or experience technical issues that affect availability.

Pricing & Payment

4.1 Current Pricing: The Service is currently offered free of charge during our launch period.

4.2 Future Pricing: We reserve the right to introduce subscription fees (monthly or yearly plans) for the Service. Users will be notified at least 30 days in advance of any pricing changes.

4.3 Payment Processing: When subscription fees are implemented, payments will be processed through Stripe. You agree to provide accurate payment information and authorize us to charge the applicable fees to your payment method.

4.4 Refunds: Refund policies will be established and communicated when paid subscriptions are introduced.

User Content & Data

5.1 Your Content: You retain all rights to your User Content. By uploading or submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your content solely for the purpose of providing and improving the Service.

5.2 Content Responsibility: You are solely responsible for your User Content and the consequences of posting or publishing it. You warrant that:

You have all necessary rights to your User Content
Your User Content does not infringe any third-party rights
Your User Content complies with all applicable laws

5.3 Registration Data: You are responsible for obtaining necessary consents from event attendees whose data you collect through the Platform. You must comply with all applicable data protection laws, including GDPR and UK Data Protection Act 2018.

Integrations and Third-Party Services

6.1 Available Integrations: The Service integrates with third-party services including:

HubSpot (for registration data transfer)
Livestorm (for webinar form integration)
Typeform (for registration forms)
Slack (for registration notifications)
Google Analytics (for analytics)
PostHog (for product analytics)
Resend (for email services)

6.2 Third-Party Terms: Your use of integrated services is subject to their respective terms and conditions. We are not responsible for the availability, functionality, or policies of third-party services.

6.3 Data Sharing: By using integrations, you authorize us to share relevant data with these third-party services as necessary to provide the functionality you've requested.

Prohibited Uses

You agree not to:

Use the Service for any illegal or unauthorized purpose
Violate any laws in your jurisdiction
Transmit any malicious code, viruses, or destructive content
Attempt to gain unauthorized access to our systems or other users' accounts
Interfere with or disrupt the Service or servers
Create event pages that contain offensive, defamatory, or harmful content
Use the Service to collect personal data without proper consent
Resell, sublicense, or redistribute the Service without our permission
Use automated systems or bots to access the Service without permission
Impersonate another person or entity

Intellectual Property

8.1 Our Property: The Platform, including all software, design, text, images, and other content (excluding User Content), is owned by Eventlink Technologies LTD and is protected by intellectual property laws.

8.2 License to Use: We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

8.3 Feedback: Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to compensate you.

Privacy & Data Protection

9.1 Privacy Policy: Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9.2 Data Processing: We process personal data in accordance with the UK Data Protection Act 2018 and GDPR. For business users processing personal data through our Platform, we will enter into appropriate data processing agreements as required.

9.3 Data Security: We implement reasonable security measures to protect your data, but cannot guarantee absolute security. You acknowledge that you provide information at your own risk.

Disclaimers and Warranties

10.1 As-Is Service: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee: We do not warrant that:

The Service will meet all your requirements
The Service will be uninterrupted, secure, or error-free
Results obtained from the Service will be accurate or reliable

Limitation of Liability

11.1 Exclusion: TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVENTLINK TECHNOLOGIES LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11.2 Cap on Liability: IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR £100 IF NO PAYMENTS HAVE BEEN MADE.

Indemnification

You agree to indemnify, defend, and hold harmless Eventlink Technologies LTD, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Your User Content
Your collection and use of Registration Data

Termination

13.1 By You: You may terminate your account at any time by contacting us or using the account deletion feature if available.

13.2 By Us: We may suspend or terminate your account immediately if:

You breach these Terms
We reasonably suspect fraudulent, illegal, or harmful activity
Required by law

13.3 Effect of Termination: Upon termination:

Your right to use the Service ceases immediately
We may delete your account and associated data after a reasonable period
Provisions that should survive termination will remain in effect

Modification of Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the changes become effective constitutes acceptance of the revised Terms.

Governing Laws and Disputes

15.1 Governing Law: These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

15.2 Jurisdiction: You agree to submit to the exclusive jurisdiction of the courts of England and Wales for any disputes arising from these Terms or your use of the Service.

15.3 Dispute Resolution: Before initiating legal proceedings, parties agree to attempt to resolve disputes through good faith negotiation for a period of at least 30 days.

General Provisions

16.1 Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Eventlink regarding the Service.

16.2 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 Waiver: Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

16.4 Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

16.5 Force Majeure: Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control.
